Page 27 <br />Section 1.04 <br />(83b) "Parent corporation" means a corporation which owns or controls the <br />applicant. <br />(84) "Perennial stream" means a stream or part of a stream that flows <br />continuously during all of the calendar year as a result of ground water <br />discharge or surface runoff. The term does not include intermittent <br />stream or ephemeral stream. <br />(85) "Performance bond" means a surety bond, collateral bond, or <br />self -bond or a combination thereof, by which a permittee assures <br />faithful performance of all the requirements of the Act, these Rules, <br />the permit, and the reclamation plan.(86) "Permanent <br />diversion" means a diversion remaining after surface coal mining and <br />reclamation operations are completed which have been approved for <br />retention by the Board and Division and other appropriate State and <br />Federal agencies. <br />(86a) "Permanent impoundment" means an impoundment which is approved <br />by the Division, and if required, by other State and Federal agencies for <br />retention as part of the post - mining land use. <br />103(16) (87) " it_ means a permit to conduct surface coal mining and <br />reclamation operations. <br />103(17) (88) " Permit appli cant" means a person applying for a permit. <br />103(18) (89) "Permit area" means the area of land indicated on the approved map matte <br />su y the operator with his /her application, which area of land <br />shall be covered by the operator's bond as required by the Act and these <br />Rules. The permit boundary, which shall circumscribe the permit area, <br />shall be identified through a complete and detailed legal description as <br />required by Rule 2.03.6. Permit area includes all areas of land which <br />are or will be affected by surface coal mining and reclamation <br />operations during the term of the permit. <br />103(19) (90) " Permit revisi means a significant alteration of the terms or <br />requirements of a permit issued under the Rules and the Act, including, <br />but not limited to, significant changes in the reclamation plan, and other <br />actions which the Board may by regulation prescribe. "Permit <br />revision" does not include a technical revision as defined in 1.04(136). <br />
