• <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />IN THE MATTER OF WESTERN FUELS - COLORADO LLC, NEW HORIZON <br />MINE PERMIT No. C-1981-001 <br />APPLICANT'S LIST OF EXHIBITS AND WITNESSES <br />Pursuant to the Hearing Officer's Proposed Order dated November 4, 2010 and Order <br />dated November 8, 2010, Western Fuels - Colorado, LLC ("WFC") submits the <br />following List of Exhibits and Witnesses. <br />1. Witnesses <br />WFC may call the following witnesses in order to present its case-in-chief during the <br />time allotted for such presentation by the Hearing Officer. WFC may also call any of the <br />following witnesses for impeachment or rebuttal purposes. <br />Lance Wade, Mine Manager, WFC, P.O Box 628, Nucla, Colorado 81424. Mr. Wade <br />will address the issues identified in the Proposed Order dated November 4, 2010, and any <br />other matters as needed for rebuttal or impeachment purposes in response to matters <br />raised by any witness named by any other Party. Mr. Wade may also testify as to <br />meetings between WFC and the Morgan family, the economic benefits of the mining <br />operation for the local community, including royalty and tax payments made to the <br />community. <br />Ross Gubka, Chief Engineer, WFC P.O Box 628, Nucla, Colorado 81424. Mr. Gubka <br />will address the issues identified in the Proposed Order dated November 4, 2010, and <br />any other matters as needed for rebuttal or impeachment purposes in response to matters <br />raised by any witness named by any other Party. Mr. Gubka may also testify as to <br />meetings with the Morgan family, meetings among NRCS and Division personnel <br />concerning Prime Farmlands, and other relevant issues. <br />Greg Lewicki, Greg Lewicki & Associates, PLLC, 11541 Warrington Court, Parker, <br />Colorado 80138. Mr. Lewicki may testify as to the issues identified in the Proposed <br />Order dated November 4, 2010, and any other matters as needed for rebuttal or <br />impeachment purposes in response to matters raised by any witness named by any other <br />Party. If necessary, and only as needed for rebuttal purposes, Mr. Lewicki may also <br />testify concerning the history of the Prime Farmlands determination for the Morgan <br />property, WFC's receipt of a negative soil survey in 1998, and WFC's immediate <br />corrective actions once the soils were determined to be Prime Farmlands. In identifying <br />this subject matter as a potential rebuttal topic, WFC does not waive any objection to the <br />raising of this issue during the hearing on the grounds of relevance or any other ground.
