The Division's preliminary adequacy review is therefore due to
be issued within 60 days of the completeness, which is December 24, 2010.
The applicant, Western Fuels — Colorado, LLC proposes to develop a surface coal mine on
approximately 322 acres (the entire western I/z of Section 25) located northwest of the town of
Nucla in western Montrose County. In addition to the mining and operations area, the
application also includes an equipment corridor which will connect the new mine to the currently
permitted New Horizon Mine. (Please see the attached Google Earth photo, for reference.)
All of the surface and mineral rights are privately owned.
The permit application package consists of three volumes. Complete copies of the application
are located in the Denver (Sandy Brown), Grand Junction and Durango offices. I am requesting
your assistance in reviewing this application, as enumerated on the attached spreadsheet.
In order to accomplish the final compilation of the preliminary adequacy review within the
regulatory timeframe, I would like to request that your review comments be submitted to me by
Friday, 10 December 2010. Please let me know in advance if you will be unable to meet this
deadline.
Thank you for your assistance.
Attachments
Photograph of Permit Area
2.
