Regarding Final Cominents for Permit Revision No. 12 (PR -12)

The purpose of this memo is to update you on the meeting that was held today at Jim Stover's
office regarding some final revisions that needed to be made to the permit text for PR -12.
Attending the meeting were Jim Stover and myself:
After reviewing the latest submittal package for PR -12 that was received in the Grand Junction
Field Office on November, 5, 2010 I have a few remaining comments to be incorporated into the
revised text. I felt that it was most expedient to discuss these changes in person with Jim Stover
so that we were both in agreement. The following changes should be made to pages 2.04 -32 and
2.05 -124.
1. In the fourth paragraph of page 2.04 -32, a sentence should be added describing that well
TC -03 -01 (R) will be discontinued based on the demonstration that the Rollins sandstone
will not be impacted by mining in the west expansion area (see pages 2.05 -115 and 116).
This well will remain open for future sampling if necessary at the time of bond release.
2. In the first sentence of the fifth paragraph of page 2.04 -32, the word "up gradient" should
be replaced with "down gradient ". A sentence should be added stating that "Although
this well is located up gradient of the Terror creek Mains, it primarily down gradient from
the west mining expansion area."
3. In the second to last paragraph of page 2.04 -32 reference to "up gradient" should be
changed to "down gradient" and the following sentence should be added. "Well TC -03-
03 has had a pinched casing since 2006 and this well is scheduled to be abandoned."
4. On page 2.05 -124, the completion information "Upper B -Seam and Sandstone above -
dry conditions" and "Upper B- Seam" should be added for wells CWI -DH -58 and CWI-
