OF <br />Dear Mr. Marshall: REGLAP_,IR,TtOiv MINING & SAFETY <br />Enclosed are two copies of American Soda'sCOth Quarterly Report in ompliance with <br />Hard Rock Mining Operation Permit No. M-99-002. One copy of the document is not <br />bound so it can easily be electronically scanned. These documents include environmental <br />ground water monitoring data collected and compiled during our fortieth quarter of <br />operations (September 2010). No solution mining activity occurred during the report <br />period. <br />The ground water data summary report is spiral bound as a non-confidential document and <br />includes a comparison of the 40th operational quarter with baseline and operational <br />general statistics prior to the current reporting period. In addition, the tables provide <br />information for comparison of Ground Water Standards as provided in Regulation No. 41 <br />and Numeric Protective Levels and Early Warning Indicators as amended in TR-4. <br />Comparison of the data values with the Early Warning Indicators (EWI) and the Numeric <br />Protective Levels (NPL) indicates four values above the calculated EWI or NPL during the <br />sample period. The value for total alkalinity and dissolved sodium flagged above the EWI <br />at down gradient alluvial monitoring well 21-5. Additionally dissolved sodium flagged <br />above the NPL at Uinta well 21-3U and upper aquifer well 21-3A - two zones of the <br />multiple completion point of compliance well located down-gradient from the 0 - 5 year <br />mining panel. No other constituents flagged at any other wells. Hydrographs <br />representing the period of record for these constituents at these locations are provided <br />along with a summary of the data in the Executive Summary of the Ground Water <br />Monitoring report. <br />Mechanical integrity testing of the remaining production wells was completed on August 16 <br />and 17, 2010. One well string, the short string of well 29-34 was subsequently plugged <br />and abandoned on October 15, 2010 after it failed to pass mechanical integrity testing. <br />Delivering a Crystal Clear Advantage <br />www.americansoda.com
