Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to Approve <br />Bond Release Application No. 6 (SL-6) for the Roadside Portals, Permit No. C-1981-041. The mine is <br />operated by Snowcap Coal Company, Inc. under the provisions of the Colorado Surface Coal Mining <br />Reclamation Act of 1979. The bond release application was submitted by Snowcap Coal Company, Inc. <br />on May 19, 2010. Snowcap Coal Company is requesting release of Phase II and III bond liability on 14.8 <br />reclaimed acres of its total 3,016 acres within the pen-nit boundary at the Roadside North and South <br />Portals Mine. The purpose of this Bond Release Request is to release those lands within the permit <br />boundary located at the South Portal and having a designation of Industrial as the post-mining land use. <br />The 14.8 acres have been fully reclaimed and an Industrial land use has been implemented. A surety bond <br />in the amount of $1,640,413.00 is in place of which $67,420.00 is being requested for release. The <br />affected area is located in Mesa County, approximately 5 miles North of Palisade, Colorado. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the <br />Mesa County Clerk and Recorder. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
