MEMBERS OF THE BOARD <br />&Western Fuels Colorado LLC <br />The objectors, JoEllen Turner and Michael Morgan are requesting a 30 day extension to the <br />Formal hearing that has been set for November 17 and 18`", 2010. JoEllen Turner and Michael <br />Morgan are also requesting Relief for all the items that have been submitted by Western Fuels as <br />being accurate but actually are not reflecting accuracy. <br />The pre - hearing conference was set for November 3, 2010 at 10:00 A.M. The objectors, JoEllen <br />Turner and Michael Morgan did not receive this notification until November2, 2010. JoEllen <br />Turner and Michael Morgan was directed by Bruce Stover, the hearing officer that a written order <br />would be given to them directing future courses. On Thursday 4, 2010, a document was mailed <br />for that Order. JoEllen and Michael Morgan did not receive that Order until Saturday the 6, <br />2010. Everything in Nucla , Colorado is closed on Saturday and Sunday that can make copies <br />and there was nothing open to buy copy paper to make 15 copies, three hole punched of any <br />documents. The closest town that would have those facilities was 2 hours away one direction. If <br />that was even possible, there is no FedEx available and no post office in this area was open. The <br />materials were suppose to be delivered to the DBMS as well as to the Denver office for WFC <br />attorney by Monday at the close of business. This could not be done any way possible. If we <br />even FedExed it on Monday or UPS, or Postal, the soonest that it could be delivered is one day <br />FexEx, 2 day Postal or UPS. So, the pre- conference hearing officer was asking the impossible. <br />Soil analysis, as well as documentation from other soil scientist, and soil samples will not be <br />back in that short of time to present proper evidence. <br />We are again asking relief for the evidence that Western Fuels has submitted and are requesting <br />an extension in this hearing as well as an extension for submittal of witnesses, exhibits, 15 copies <br />of documentation. We do not feel that the pre - conference allowed us to present evidence in PR- <br />06 but permitted Western Fuels to do so. Western Fuels submitted a Brief to the pre- conference <br />hearing office that we were not provided with information that we were allowed to do the same. <br />This same brief was submitted to all of my witnesses accusing three of our most outstanding <br />teaches that are very honorable as being dishonest and forging documents. My witnesses are now <br />scared that because of what they have unjustly accused the school teachers of, that they too will <br />be attacked. My witnesses are just farmers that have purchased hay or corn and know how this <br />place is and was. All witnesses do not need to be treated that way. One of the school teachers <br />was so shook up that she cried for hours. All of my witnesses received this documentation and <br />they do not deserve to be treated that way. This is a public formal hearing and we should have <br />been permitted to be heard on anything that is part of PR -06 that affects our property. The pre- <br />conference hearing officer received this documentation before the hearing and we had not even <br />been informed of the date of the pre - conference hearing at that time. There were no numbers that <br />Mr. Stover could be contacted, no telephone number, no fax number, not any address. They are <br />a� <br />
