means, the amount of water necessary to reclaim agricultural land to the conditions it was prior to <br />the mine entering the property. Articles state that there should be less destructive methods of <br />Surface Coal Mining operations and better methods of land reclamation, and a more effective <br />land use. Section X4.15. J 1 states that all areas affected by surface coal. mining operations shall be <br />restored in a timely manner. Western Fuels leased this place in 1998 and we have been out of <br />production. for almost 10 years on almost all of the property leased. The land. must be restored to <br />(1) conditions that are capable of supporting the uses which they were capable of supporting <br />before any mining (2) to a higher or better use achievable. <br />We appreciate the time you have donated to hear the things that have occurred and that have <br />brought us to this hearing. We hope that you will listen with an open mind and take all facts into <br />consideration before making any decisions. We have come before you at no fault of ours. We <br />are just farmers and as farmers we depended solely on the mine to present information that was <br />accurate to the Division and for the Division to protect us from the adverse affects of mining. <br />We expect and depend on the Division to know the Rules and Regulations and that they will <br />enforce those rules and regulations protecting the landowner, and the landowner rights, and the <br />property of the landowner. We are g=anteed that the land will be returned to as Good as or <br />better than it was and will not accept less than what we had. PR-06 does not provide us with <br />those conditions.
