Issue a Cease and Desist Order for all lands affected outside of the approved boundary <br />until all corrective actions required are completed. <br />Corrective Action(s): <br />Require the Operator to submit and receive approval of an Amendment or 112c <br />Conversion application to encompass the land affected outside of the current approved <br />permit boundary. If the Operator chooses to submit an Amendment to modify the permit <br />boundary, they must also submit and obtain approval of an Acreage Reduction for a <br />portion of the current approved permit area un-affected by the mining operation in order <br />to apply that acreage to encompass the land affected outside of permit boundary. The <br />Amendment or Conversion Application shall be submitted by March 15, 2011 with all the <br />materials in an approvable form by July 13, 2011. <br />Civil Penalty: <br />For a violation of C.R.S. 34-32.5-116 (4) (i), a Civil Penalty may be assessed at a rate of <br />$100.00 to $1,000.00 for each day of violation. In this case, there are 51 days of <br />violation (from the date of inspection on September 27, 2010 to the November 17, Board <br />Meeting). <br />The Division will access a civil penalty of $100.00 per day of violation for 51 days.
