the surface mine. GCC Rio Grande, Inc, through the State Land Board, has <br />obtained three well permits from the State Engineer's Office for withdrawing <br />non-tributary groundwater. The three well permits allow withdrawal of <br />groundwater totaling 228.3 acre feet per year. GCC Rio Grande, Inc. is <br />negotiating a lease with the Pueblo Board of Water Works, which contemplates <br />GCC Rio Grande, Inc. leasing 250 acre feet per year of water for the facility. <br />The Pueblo Board of Water Works approved the lease of water to GCC Rio <br />Grande, Inc. by Board Motion on June 20, 2000 (Attached as Appendix I)." <br />These submittals are in compliance with Rules 6.4.7(3) and (4). <br />9. Does the applicant adequately describe drainage control during mining and after <br />mining, including all water diversions and impoundments? (Rule 6.4.4(c), <br />6.4.7(2)(c) <br />The applicant addresses drainage control in Exhibit D, pages D-9 through D- <br />13, and during mining in maps Exhibits D-1, D-2, and D-3 and post mining <br />drainage in Exhibit F-1. The drainage control plans comply with the <br />requirements of Rule 6.4.4(c) and 6.4.7(c). <br />10. Has the applicant adequately described what measures will be taken to minimize <br />disturbance to the prevailing hydrologic balance, prevent off-site damage, and <br />provide for a stable configuration of the reclaimed surface? (Rule 6.4.4) <br />The applicant plans to protect the prevailing hydrologic balance by trapping <br />storm-water in an in pit sediment pond, sample the water for nitrates, nitrites, <br />and ammonia prior to discharge of the water into the appropriate arroyo. They <br />plan to control blasting operations to minimize release ofANFO to the water. <br />These measures will prevent off-site damage and minimize damage to the <br />hydrologic balance. The reclamation plan provides for a stable configuration <br />of the reclaimed surface. These submittals comply with Rule 6.4.4. <br />Wildlife <br />11. Does the application adequately address the significant wildlife resources on the <br />affected land and the effect of the proposed operation on those resources? (Rule <br />6.4.8) <br />The application does adequately address the significant wildlife resources on <br />the affected areas as well as addressing the anticipated impacts. References are <br />made to the United States Fish and Wildlife Service, the Colorado Division of <br />Wildlife, and the Colorado Natural Heritage Program for consultation prior to <br />and during permit preparation. Furthermore, CDOW was notified when the <br />application was received and no additional comments were received from their <br />office.
