Also <br />enclosed for your perusal are some pertinent documents from the application file as <br />described in the last paragraph of this memo. <br />D I V I S I ON OF <br />MINERALS <br />GEOLOGY <br />RECLAMATION <br />MINING-SAFETY <br />Bill Owens <br />Governor <br />Greg E. Cattany <br />Acting Division Director <br />The application was submitted on Januaryl8, 2002 and deemed complete for technical <br />review on March 13, 2002. The final day for public comment was May 2, 2002 and a <br />total of 67 (72 total) letters of objection were received prior to that date. The Pre-Hearing <br />Conference was held on May 30, 2002 in Pueblo and the resultant order was sent to all <br />parties on June 6, 2002. The Division sent out it's preliminary adequacy letter on May 6, <br />2002. Due to the complexity of responding to some of the concerns outlined in that <br />letter, the applicant requested an extension from the original decision date of June 13, <br />2002 until August 23, 2002. The applicant submitted responses to the initial adequacy on <br />July 9, 2002. The Division identified additional concerns in letters of July 12 and July <br />17, 2002. The applicant submitted acceptable responses to these concerns on July 24, <br />2002. One of these responses was deemed to be a technical revision to the application, <br />thereby, delaying a staff recommendation until August 13, 2002. <br />This recommendation and the rationale for the recommendation are attached to this <br />mailing along with several other documents. These include; List of DMG witnesses and <br />exhibits; Summary of issues keyed to their respective letter of comment along with the <br />complete list of commentors; Five parties to the hearing with their lists of witnesses and <br />exhibits and; The applicant's list of witnesses and exhibits. <br />Enclosure(s) <br />xc: Tom Roan AGO <br />Steve Brown AGO
