EI yE <br />d of 01 20 <br />Divisk)n o I'c:ILy'nation, <br />RE: Documentation of Proof of Publication and Notice to Owners of Record of Amendment <br />Dear Mr. Scott: <br />Enclosed are copies of the Proof of Publications of the Public Notice Legal Advertisement that was <br />placed in local area newspapers including the Herald Democrat, the Eagle Valley Enterprise, and the <br />Summit County Journal. Also enclosed are the letters and their associated certified mail receipts sent <br />Whe Owners of Record as listed in Exhibit O of Amendment AM-06 to the Climax Reclamation <br />Permit (M-1977-493). In accordance with the requirements for submitting a Reclamation Permit <br />Amendment set forth in the Mineral Rules and Regulations of the Colorado Mined Land Reclamation <br />Board for Hard Rock, Metal, and Designated Mining Operations, Owners of Record of Affected Land <br />have been notified of Reclamation Permit Amendment Application AM-06. These letters were sent to <br />the Owners of Record on September 3, 2010 following the first publication of the Public Notice in area <br />newspapers regarding the Amendment AM-06 to the Climax Mining and Reclamation Permit. <br />Delivery confirmations for 13 of the 15 Certified Letters were obtained by September 13, 2010. <br />The Certified Letter sent to Leadville CO and Southern Scenic Railroad was returned due to "No mail <br />receptacle". An updated address was obtained from Leadville CO and Southern Scenic Railroad, and <br />a second Certified Letter was sent to this updated address on September 21, 2010. No Record of <br />Delivery of this letter was available, and a third Certified Letter was sent to Leadville CO and <br />Southern Scenic Railroad on October 14, 2010. Delivery of this letter was confirmed on October 19, <br />2010. <br />The Certified Letter sent to Robert Crater was returned to sender on October 14, 2010 because it was <br />not claimed by the addressee. Mr. Crater had been previously contacted by phone on September 23, <br />2010 to verify that the address was correct. A second Certified Letter was sent to Robert Crater on <br />October 14, 2010. Mr. Crater was contacted by phone on October 21, 2010 to re-verify the address. <br />Mr. Crater stated that he had received multiple notices of the Certified Letter but that he had not <br />picked up the letter from the Post Office. He also stated that he had the current notice for the letter <br />sent on October 14, 2010.
