<br />Amendment to Right-of-Way No. 1457 Book 14
<br />This is an Amendment, hereinafter referred to as AMENDMENT, to Right-of-Way No. 1457 Book 14 made
<br />this 1 st day of .tune, 2007 between the State of Colorado, acting by and through the STATE BOARD OF LAND
<br />COMMISSIONERS (Grantor), whose address is 1313 Sherman Street, Suite 621, Denver CO 80203 and Tri-State
<br />Generation and Transmission Association, Inc., (Grantee), whose mailing address is P.O. Box 33695, Denver,
<br />CO 80233-0695:

<br />WHEREAS, Grantee has applied to the Grantor to amend the existing Right-of-Way Contract No. 1457 Book
<br />14 to relocate a part of the right-of-way located in Section 16 Township 3 North, Range 93 West of the 6°i P.M.,
<br />Moffat County across certain portions of state trust lands for the purpose of constructing, operating, and maintaining
<br />a 138kV above ground transmission line; and
<br />NOW THEREFORE, the Grantor for the consideration. of Five Thousand and 00/1.00 Dollars ($5000.00),
<br />agrees to amend Right-of-Way Contract No. 1457 Book 14, to relocate the part of the right-of-way located in Section.
<br />16 Township 3 North, Range 93 West of the 6`h P.M., Moffat County for the purpose of constructing, operating, and
<br />maintaining a 138kV above ground transmission line over, under, upon and across certain portions of state trust
<br />lands described as follows:
<br />Township 3 North, Range 93 West of the 6th PM, Moffat County
<br />Section 16: SE
<br />An electrical easement located in the southeast quarter of Section 16, Township
<br />3 North, Range 93 West of the 6th P.M., Moffat County, Colorado, said
<br />easement being 100 feet in width and lying 50 feet on each side of the
<br />following described centerline:
<br />Beginning at a point lying on the South line of the southeast quarter of said
<br />Section 16, said point lying North 88142'22" West 989.76 feet from the
<br />southeast corner of said Section 16;
<br />thence North 37°05'04" East 1700.35 feet to the East line of the southeast
<br />quarter of said Section 16 and the Point of Termination of said easement,
<br />said point lying North 01'29'13" East 1379.26 feet from the southeast
<br />corner of said Section 16.
<br />Said strip of land contains 5,131.5 square feet (.118 acres) more or less.
<br />The lands described above are incorporated into and made a part of Right-of-Way No. 1457 Book 14 dated
<br />October 11th, 1963, and therefore subject to the Terms and Conditions of said Right-of-Way. The above described
<br />legal description replaces the original legal description in Right-of-Way No. 1457 Book 14 and as described below:
<br />Township 3 North, Range 93 West of the 6th PM, Moffat County
<br />Section 16: SE
<br />Beginning at a point on the North boundary of said Section 16, 1000 feet West
<br />of the Northeast corner of said Section 16:
<br />'T'hence S 16°21'30" W 677.7 feet;
<br />Thence S 1.3°23'20" W 4,752.3 feet, to a point on the South boundary of said
<br />Section 16, 2,265 feet, to a point on the South boundary of said Section 16,
<br />2,265 feet West of the Southeast corner of said Section 16.
<br />A plat and survey performed by Peter Epp, Colorado .PLS No. 14815, dated February 28`', 2007 was
<br />submitted by the applicant to depict the location of said land. Said plat is hereby made a part of this Amendment for
<br />locational purposes, but shall not prevail over the Terms and Conditions of Right-of-Way Contract 1457 Book 14.
