PERMIT #: M-1983-011 <br />INSPECTOR'S INITIALS: DMC <br />INSPECTION DATE: October 14, 2010 <br />3. INSPECTION TOPIC: Off-site Damage <br />PROBLEM/POSSIBLE VIOLATION: Problem: Land has been affected outside of the approved permit boundary. This is a <br />possible violation at this time pursuant to: 1.) C.R.S. 34-32-109(1) for failure to first obtain from the board or office a <br />reclamation permit prior to engaging in a new operation. AND/OR 2.) C.R.S. 34-32-116(7)(h) for failure to protect areas <br />outside of the affected land from slides or damages occurring during the mining operation. <br />CORRECTIVE ACTIONS: This possible violation will require a hearing before the Mined Land Reclamation Board. The <br />schedule and other details for the MLRB hearing will be provided under a separate document to be sent via certified mail to the <br />operator. <br />CORRECTIVE ACTION DUE DATE: 12/15/10 <br />4. INSPECTION TOPIC: Other <br />PROBLEM/POSSIBLE VIOLATION: Problem: Trash and refuse was noted on the site. This is a problem at this time for <br />failure to dispose of refuse in a manner that controls unsightliness or deleterious effects of such refuse pursuant to C.R.S. 34- <br />32-116(7)(d). <br />CORRECTIVE ACTIONS: The operator shall submit a written notice to the Division with photo documentation, that the <br />refuse has been removed from the site by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 11/26/10 <br />5. INSPECTION TOPIC: Signs & Markers <br />PROBLEMMOSSIBLE VIOLATION: Problem: The mine identification sign and affected area boundary markers were not <br />observed per the requirements of Rule 3.1.12. <br />CORRECTIVE ACTIONS: The operator must post a sign at the entrance to the mine site which shall be clearly visible from <br />the access road and specify the following, the name of the operator, indicate that a reclamation permit for the operation has <br />been issued by the Colorado Mined Land Reclamation Board, and the permit number. The boundaries of the affected area must <br />be marked by monuments or other markers that are clearly visible and adequate to delineate such boundaries. <br />CORRECTIVE ACTION DUE DATE: 11/26/10 <br />6. INSPECTION TOPIC: Availability Of Records <br />PROBLEM/POSSIBLE VIOLATION: Problem: DBMS does not have a map that clearly delineates the affected area <br />boundary and current site conditions. <br />CORRECTIVE ACTIONS: Submit a map to DBMS prepared by a registered land surveyor, professional engineer, or other <br />qualified person that includes the approved affected area boundaries and current site conditions. <br />CORRECTIVE ACTION DUE DATE: 11/26/10 <br />7. INSPECTION TOPIC: Topsoil <br />PROBLEM/POSSIBLE VIOLATION: Problem: The topsoil stockpiled at the northeast end of the pit as a stornwater <br />management berm is highly susceptible to erosion, and is not stored in accordance with Rule 3.1.9 <br />CORRECTIVE ACTIONS: The operator shall relocate the topsoil material and store it in accordance with Rule 3.1.9. <br />CORRECTIVE ACTION DUE DATE: 11/26/10 <br />Page 2 of 5
