October 24, 2010
Members of the Board
Division of Reclamation, Mining, and Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203
To the Members of the Board, `-
My name is-Ruth Duffy. I have a master's degree in English from the University of Wisconsin -
Milwaukee. I have taught English at high school and college levels for over 20 years.
Recently Ms. JoEllen Turner, a resident of Nucla;'Colorado, brought me a copy of the soil
survey that was done by Jim Irvine of Intermountain Resource on the Morgan property and
other properties in 1998. She asked that I read and interpret the following statement:
Barx soil as used in this survey is not considered as not being prime farmland ...
Because of the use of the second not in this sentence, what we have here is a double negative
a term in grammar -- which turns the statement into a positive. In other words, it actually says.
Barx soil as used in this survey is considered ds being prime farmland. You need to understand
ghat double negatives, actually mean the opposite. A consultation of any standard English
grammar text will verify this. The use of double negatives is considered poor grammar and not
advised because it can lead to misunderstanding, as seems to be the case here.
Should.you, need me to state my position on this interpretation in person, I would do so at any
formal hearing held in Nucla or please feel free to contact me by telephone at the number listed
below.
Sincerely,
Ruth Duffy
P.O.
