V
Attention Board Members RE -r
Division of Reclamation, Mining, and Safety
State of Colorado ?'??`f 2???
1313 Sherman Street, Room 215 Di jebn d Rsciatnatian,
Denver, Colorado 80203
October 28, 2010
Dear Board Members: We just attended a pre-conference with the Board that we were told that
we could not speak at. I received a FedX package 15 minutes before we had to be at the meeting
place by tracking the Fed X man down and meeting him a long ways from where we live.
The Rules and Regulations state that we have 30 days from the initial publication for comments
and objections. That period ends for these comments on November 15, 2010. If you have
already decided on a formal hearing date, how do the people who file their objections on
November 15, 2010 attend this meeting which you decided to have in Denver on November 17'?
We are again requesting that the meeting be here. This is where the operator is, this is where the
landowners are, and this is where anything that can be seen that adversely affecting us is.
PR-06 is 2300 pages of maps and documentation that most people haven't even been able to
begin to finish reading. It adversely affects all of us. PR-06 is from 1992 to 2010. It includes
and covers everything having to do with all the permits and Revisions, and land owners from that
,period of time on. You state in a letter to me that I am not "specific enough." We are farmers
- - `here, not anything else. We all wrote letters stating how PR-06 affects us. We pointed out all the
main items and explained those. We are not going back through 2300 pages and pick out a
specific page number and a specific quote and wording. That changes in every addition of PR-
06. We are trying to tell you how we are affected and what damages have been done because the
mine did not do their job and the Division did not do their jobs which was to protect us and our
property.
If you will not hold the meeting here, or come and see the damages for yourselves, then we
would like to request a Scipe meeting. A video conference. A conference on those days that can
be set up here through the computers so that we can be at the meeting and so can everyone else
and we can see you and you can see us. The county has the facility, the library, or the school. All
of this would have to be arranged, but with your approval, we would like to try this. It is easier
to bring you to the mountain than try and bring the mountain to you.
Jim Boyd San Miguel Soil Conservation District
40785 Hwy 145
Norwood, Colorado 81423
970-327-4245
