<br />OCl 29 Z, <br />October 28, 2010 <br /> <br />AGGREGATE <br />Mr. Jared Ebert INDUSTRIES <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Permit No. M-1992-069, 83`d Joint Venture - Corrective Action Deadline Extension Request <br />Dear Mr. Ebert: <br />Your report of the inspection that was conducted at the above-referenced site on March 31, 2010 requires <br />that Aggregate Industries submit a technical revision to the permit to provide the Division with a <br />reclamation map that more accurately reflects the final reclaimed configuration of the site and meets the <br />requirements of Rule 6.2.1 (2) and Rule 6.4.6. The deadline for submitting the technical revision was set <br />for July 30, 2010 and subsequently extended for ninety (90) days. <br />As previously discussed during the original extension request, the owners of the 83`d Joint Venture site <br />have entered into a contract to sell the property to the City of Greeley. Closing on the sale of the property <br />is progressing but still pending and the City has therefore not disclosed their intended end use of the <br />property, which may result in minor changes to the reclaimed land form as a result of flooding of the site <br />in June. As the technical revision required by the Division is to provide a reclamation map that more <br />accurately reflects the final reclaimed configuration of the site, Aggregate Industries would like to assure <br />that any changes as a result of the City's plans and the flooding of the site can be incorporated into the <br />final map.
