Cunningham, <br />Environmental Protection Specialist <br />1313 Sherman Street, RM 215 <br />Denver, CO 80203 <br />RE: FIRST ADEQUACY REVIEW RESPONSE <br />FILE NUMBER M-1977-223 WILEY PIT (AM-01) <br />OPERATOR: SIBS Five Rivers Cattle Feeding <br />Dear Mr. Cunningham: <br />This letter is provided as clarification to design and operation aspects of the proposed Colorado Beef <br />Reservoir for the Colorado Beef feedyard owned and operated by JBS Five Rivers Cattle Feeding LLC <br />(JBS). A freshwater reservoir will be constructed on property owned by .IBS north of the leedyard that will <br />be used as a water storage structure for livestock use. Water will be transferred from the reservoir to the <br />1'ecdyard via an underground pipeline. This underground pipeline will cross man-made structures: U.S. <br />Highway 50, the Amity Canal and existing utilities. The construction of the water pipeline is not related to <br />any mining activities but is specific only to the supply of water to livestock at the feedyard. <br />The design of the pipeline considers the referenced man-made structures and no damage is expected to occur <br />to the structures during construction. Furtherniore, construction is expected to occur such that no <br />interruption will occur with the operation of the Amity Canal or the existing utilities. JBS, as owner of the <br />project, will pay for any damages that occur to the man-made structures during construction. <br />The contractor selected for project construction will be expected to complete the proiect without any damage <br />to the man-made structures. In addition, the contractor will be responsible for all utility line locates (through <br />the Utility Notification Center of Colorado) prior to construction and any damages incurred to utilities during <br />construction will be covered under the contractor's liability insurance policy as part of the project contract <br />with JBS. <br />Prior to construction, the contractor will be responsible for obtaining the required utility/special use pennit <br />from the Colorado Department of "Transportation (CDOT) for crossing U.S. Highway 50. Additionally. J13S <br />will the for a Stonnwater Construction Permit through the Colorado Department of Public Health and <br />Environment (CDPHE) prior to construction. <br />In my opinion, there should be no inherent problems associated with this pipeline construction project and <br />that no damage is expected to occur to any manmade structures.
