BOX 631 <br />LAMAR, CO 81052 <br />6.4.19 EXHIBIT S- PERMANENT MAN-MADE STRUCTURES <br />The applicant has mailed or contact them in person all of the owners of any man-made <br />structure with in 200 feet of the permit boundary. The applicant is working closely with <br />ATMOS ENERGY on obtaining their permission to operate the mining activity with in the <br />boundaries of the proposed amended permit. The applicant has been in contact with <br />ATMOS ENERGY and is working with Michael Johnson with Atmos Energy in order to <br />get an agreement with them. The applicant has mailed two (2) Certified Return Receipt <br />U.S. Mail notifications and is now waiting for a reply from Atmos Energy. The proofs of <br />the mailings are enclosed with this adequacy package. <br />All of the other owners of man-made structures have returned agreements pertaining to our <br />request for them to help the applicant comply with Rule 6.4.19. The agreements are <br />enclosed with this adequacy letter. Additionally the applicant has enclosed a letter written <br />by the engineer of record Gary Chapman for this project stated, " In my opinion, there <br />should be n.o inherent problems associated with this pipeline construction project and that <br />no damage is expected to occur to any manmade structures."
