Everist property is to the north-northeast, <br />while the gradient on the Bachofer property is to the north-northwest; both toward the river. <br />This is illustrated on Figure 29 (attached) of the USGS Report 2010-5019 referenced by Mr. <br />Bachofer. We have indicated the approximate locations of the Everist Mine and the Bachofer <br />property, and the directions of the groundwater gradient. Since the Bachofer property is not <br />upgradient or downgradient from L.G. Everist's property, flooding on Mr. Bachofer's <br />property cannot be attributed to L.G. Everist's operation. <br />Further, USGS Scientific Report 2010-5019 referenced by Mr. Bachofer included Model Simulations <br />3 and 4 which projected groundwater level changes by the year 2055 due to reclamation of gravel <br />mines along this stretch of the South Platte River. The results of the model simulations indicated no <br />changes in the groundwater elevations at the Bachofer property due to lining of the Everist Mine <br />cells. We have attached copies of Figures 34 and 36 of the report indicating the approximate <br />locations of the Everist Mine and the Bachofer property. <br />In summary, Mr. Bachofer's contention that flooding of his property is somehow caused by L.G. <br />Everist's mining operations has no merit. The scientific paper he has referenced to explain a <br />supposed relationship between the slurry walls and flooding on his property actually does not contain <br />such an explanation. Rather the report provides information and modeling that indicates L.G. <br />Everist's operations do not affect his property. If, in fact, Mr. Bachofer is experiencing flooding <br />more frequently than previously experienced, it may be the result of continuing urbanization of parts <br />of the South Platte River basin in areas upstream, but is not a result of L.G.
