The data available <br />from the Al and Derr wells would provide the information necessary to conduct an evaluation of <br />future groundwater changes in the event a neighbor experiences groundwater problems which <br />may be alleged as an impact from mining and reclamation activities. <br />With regard to a mitigation plan as requested by the Division, Al provided its commitment to <br />mitigating impacts that may occur as a result of its operations in conjunction with obtaining a <br />gravel pit well permit for the East 8 h Street Operation through the State Engineer's Office. <br />During the application process for the gravel pit well permit, the District 3 Water Commissioner's <br />office identified wells located 600 feet or closer to the property boundaries of the East 8`'' Street <br />Operation. A copy of the Water Commissioner's January 27, 2005 letter, in which the wells are <br />identified, together with a map showing the location of the those wells, is enclosed for reference. <br />In support of obtaining well spacing waivers from the well owners, Al provided its written <br />mitigation commitment for groundwater impacts if AI's activities are determined to be a <br />significant contributing factor to such groundwater changes. Copies of the executed well spacing <br />waivers and AI's written commitments are enclosed. <br />In accordance with the written commitments, a mitigation trigger point based upon a well <br />owner's well performance was established. If a well owner advises Al that they are experiencing <br />problems with their well, Al will evaluate the cause based upon groundwater data obtained <br />through the monitoring program, the location of the neighboring well in relation to mining <br />activity, and regional weather and land use conditions. Due to the influence of the Derr Pit and <br />another mining operation directly west of Derr, Loloff Mine (Permit No. M-1983-112), any <br />groundwater issues that are encountered in the area between AI's East 8 h Street operation and <br />those operations to the north will need to be evaluated based upon the influence of mining and <br />reclamation activities at all three sites. <br />As stated in the commitment letters, if AI's mining activity is determined to be a significant <br />contributing factor to groundwater changes requiring mitigation, Al will implement mitigation <br />measures. The written commitments further identify various mitigation measures that may be <br />implemented. We would note that, to date, Al has not been contacted by any neighbors regarding <br />issues with groundwater changes. <br />Al respectfully requests the Division's consideration of the proposed changes to the groundwater <br />monitoring and mitigation plan for the East 8`h Street Operation as set forth above. Enclosed with <br />this request is Check No. 414134 in the amount of $216.00 for the technical revision fee.
