(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2001-085 <br />INSPECTION DATE: 04 Ortoher 2010 INSPECTOR'S INITIALS: DR? <br />OBSERVATIONS <br />This inspection was conducted by David Bird and Tony Waldron of DRMS. The site is located in Adams County <br />about 6 miles south of Brighton near the intersection of Brighton Road and East 120`' Avenue. The commodities <br />mined are sand and gravel. The total permit area and disturbed area are both listed as 49.1 acres. The Division <br />holds a bond in the amount of $281,115 for the operation against a total required amount of $585,900. The post- <br />mining land use for this site is described as developed water resource. Les Ewegen and Dave Schultejann were <br />present representing the Operator. <br />The Division was investigating three potential problems. First, the Division has been receiving calls from residents <br />or businesses in the area expressing concern about potential impacts to the hydrologic balance due to pumping <br />from the 120" Estates pit. Under the Substitute Water Supply Plan, the pumping effluent can be discharged to <br />either the Henderson Water Ski Lake or the South Platte River. Pumping to the water ski lake occurs as long as the <br />lake level does not exceed a predetermined range of depth as agreed to with the owners of the lake. Other times <br />the effluent is discharged to the South Platte River via the city of Brighton's augmentation station. The operator <br />appears to be in compliance with the pumping specifications. <br />The second problem involves the financial warranty. The operator was advised that the financial warranty held by <br />the Division for this site is insufficient. The amount that was submitted upon approval of Amendment AM-4 <br />should have been $585,900, but only $281,115 was provided. This has been cited as a problem on page 3 of this <br />report. The Division will send a letter of notification under separate cover, and the Operator should provide the <br />additional financial warranty as soon as possible, since commencing work under Amendment AM-4 without first <br />providing the required financial warranty is a potential violation. <br />The third problem has to do with overburden mined from the pit that has been placed on land that is outside of <br />the permit area. Under §34-32.5-103(1) C.R.S. and Rule 1.1(3), and §34-32.5-103(13) C.R.S. and Rule 1.1(27), the <br />area upon which spoil (overburden) is placed is defined as affected land, and the activities occurring on the <br />affected land are defined as part of the mining operation. Therefore these areas should be within the permitted <br />area. This has been cited on page 3 of this report as a potential violation of §34-32.5-116(4)(i) and (j) C.R.S. and <br />Rules 3.1.5(3) and 3.1.6(3), and the matter will be brought before the Mined Land Reclamation Board (Board). <br />The Division will send a letter under separate cover citing the reasons that we believe a violation exists at the site, <br />including details of the date and time of the Board hearing and operator rights as they pertain to the hearing. <br />I & E Contact Address <br />NAME: Dave Schulteiann <br />OPERATOR: GSL/Brush LLC <br />STREET: <br />CITY/STATE/ZIP <br />P.O.
