Designated Chemicals. <br />Dear Mr. McHale, <br />The Division of Reclamation, Mining and Safety (Division) determines if a chemical will be designated <br />based on the definition of "Designated Chemicals" as described in Rule 1.1 (13) of the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, Metal and Designated <br />Mining Operations. The Division takes into consideration the Material Safety Data Sheet (MSDS), other <br />information about the*chemical provided by the applicant and other verifiable information sources for <br />the chemical to determine if a substance fits the definition. <br />The Division does not maintain a list of designated chemicals because the process is necessarily reactive <br />to the chemicals proposed for use by applicants. For example, the Division reviewed an application <br />proposing to use another form of Xanthate, and based on the information supplied by the applicant this <br />material was considered to be a designated chemical. However, after receiving your letter, I reviewed <br />the MSDS sheet provided in the submitted 110d permit application for AERO® 317 Xanthate and believe <br />this form of Xanthate does not meet the definition of a designated chemical. <br />Given this, you will not need to supply an Emergency Response Plan for AERO° 317 Xanthate as outlined <br />in Rule 8.3. <br />Sincerely, <br />Jared Ebert <br />Environmental Protections Specialist, DRMS <br />CC: Tony Waldron, DRMS <br />Office of Office of <br />Ntined Land Reclamation Denver Grand Junction - Durango Active and Inactive Niines
