Dates of Reclamation Work: All reclamation work was undertaken between April and <br />July 2006, by C&J Gravel of Durango, Colorado. <br />Description of Bond Release Amount Request: This bond release request seeks final <br />bond and liability release at the North Pit, North Pit Haul Road, Topsoil Stockpile #2, the <br />Previously Reclaimed Spoils Area, the South Pit Drill Pad, the Equipment Yard, the <br />Carbon Junction Canyon reconstructed channel, Topsoil Stockpile #7, and ancillary areas <br />comprising approximately 30 acres in size. The areas reclaimed have been demonstrated <br />to meet the requirements for erosion control (Technical Revision 15), and meet the final <br />bond release vegetation standard for cover (Minor Revision 06 and enclosed vegetation <br />study). The site is in conformance with the approved post-mining land use which has <br />been implemented (CDRMS SL02 Findings, May 23, 2005). Remaining reclamation <br />obligations at the site include the reclamation of the two sediment ponds and reclamation <br />of Topsoil Stockpiles 4 and 8 (to be used for reclamation of the sediment ponds). <br />Protection of the Hydrologic Balance: Annual Hydrologic Reports have been <br />submitted annually for the mine and the information within the AHR's has demonstrated <br />the continued protection of the hydrologic balance at the mine site and off-site. On the <br />few occasions where sediment ponds have discharged, samples of pond discharge have <br />shown compliance with the CDPS permit. Continued monitoring of the sediment control <br />system has been continual, and where regular inspections have revealed concerns with <br />protection of the hydrologic balance, protection. measures have been implemented and <br />maintained. CDRMS approved Technical Revision 15 that demonstrated the reclamation <br />at the mine; met the requirements for sediment pond removal, and that erosion from the <br />reclaimed areas is equal or less than that from natural areas at and/or adjacent to the mine <br />site. <br />Notice to Parties Identified in Rule 3.03.2(1): Please see attached copies of letters and <br />certified receipts sent to specified parties. <br />Newspaper Advertisement: A copy of the newspaper advertisement published in the <br />Durango Herald is attached. A copy of the proof of publication is also attached. <br />Achievement of Revegetation Success <br />The report, 2008 Quantitative Vegetation Study In Support of Sediment Pond Erosion <br />' Control Demonstration, Phase III Bond Release Oakrid eg_ Energy, Inc., Carbon Junction <br />Mine, La Plata County, Colorado was submitted previously with Minor Revision 06, and <br />is incorporated herein by reference.
