Box 1750 <br />Canon City, CO 81215 <br />RE: Notice of Violation/Cease and Desist Order, Number: I0-100601-1 <br />Cotter's Temporary Trench Dewatering Activities <br />Dear Mr. Hamrick: <br />The Colorado Department of Public Health and Environment's Water Quality Control Division (the <br />"Division') has reviewed Cotter Corporation's plans for the installation of two additional alluvial <br />sumps at the Schwartzwalder Mine, including the winterization of the new and current treatment <br />delivery and return system. The additional sump locations are part of an expansion of the alluvial <br />treatment system required by paragraph 28.a. of the Notice of Violation/Cease and Desist Order, <br />Number. I0-100601-1 (the "NOV/CDO), that the Division issued to Cotter on June 1, 2010. <br />The Division hereby grants Cotter temporary authorization to dewater the trenches and excavations <br />associated with the installation and winterization of the alluvial pump and treat system, and land <br />apply the water to the retention pond excavation area located in the northwest portion of the site. <br />Cotter's temporary dewatering activities should be conducted in a manner that ensures the activities <br />do not result in a surface water discharge.
