only 60 % of the applicable reclamation bond could be released. The remaining amount, therefore, was <br />statutorily set at $4,624,936.00. Permit Renewal No. 5 was issued on May 12, 2008 but with the permit issuance <br />date of April 20, 2008. <br />In Succession of Operator No. 5 (SO-5), Cedars Energy LLC bought 98.99% of Bowie Resources LLC. The <br />revision was approved on May 28, 2009. <br />Various aspects of the reclamation plan were updated in Technical Revision No. 48, approved on July 18, 2008. <br />Stipulation No. 58 was attached to this revision and required the operator to submit an amended reclamation <br />plan for cropland areas at the train loadout. This stipulation was terminated with the proposed decision to <br />approve Technical Revision No. 53 on November 30, 2009. <br />In Technical Revision No. 52, BRL demonstrated that further quarterly inspections by BRL of the West Ridge <br />Waste Pile at the East Mine were no longer required. The Division would continue, however, to inspect this area <br />during its periodic field inspections. This revision was approved on January 22, 2010. <br />Backfilling and grading operations started at the East Mine and at the timber storage area in the spring of 2008 <br />and lasted into the summer of the following year. The soil material for backfilling the East Mine came from the <br />outslopes of the various East Mine benches and from material that had been stockpiled at the timber storage area <br />across from Steven's Gulch road. After backfilling and grading operations were completed at both sites, topsoil <br />was applied and drainage ditches, some with riprap, were established.
