Box 459 <br />Florence CO 81226 <br />Re: Southfield Mine, C1981-014, <br />Dear Mr. Patterson: <br />Request for cessation of Refuse Pile Inspections <br />First Quarter 2010 Waste Bank Inspection Report <br />COLORADO <br />D I V IS I ON OF <br />RECLAMATION <br />MINING <br />SAFETY <br />On October 12, 2010, the Division received Energy Fuels Coal, Inc."s (EFCI) request to terminate refuse disposal <br />area quarterly inspections. The Refuse Disposal Area (RDA) at the Southfield mine has been reclaimed, with the <br />last seeding of the permanent seed mix occurring in 2003, with limited inter-seeding conducted in 2004. Since <br />EFCI conducted the final reclamation activities on the RDA, minor repairs have been conducted as necessary. In <br />2007 a subsidence feature opened up on the RDA, due to subsidence of pre-law workings (Shamrock Mine). EFCI <br />repaired this opening and reseeded this small area. No new subsidence features or structural problems have been <br />observed since the 2007 subsidence. <br />Section 2.05.3 of the permit discusses EFCI's conduct of the refuse pile inspections (page 2.05.3-37B). In <br />accordance with Rule 2.08.4(2) and Rule 1.04(136), reduction or termination of approved environmental <br />monitoring programs, such as refuse pile inspections, require submittal of a technical revision to the permit. Please <br />submit a technical revision to the permit in order to request reduction or termination of conducting and submitting <br />waste bank reports in accordance with Rule 4.09.1(11) and 4.10.2(2). <br />Energy Fuels Coal, Inc. also provided the first quarter 2010 Quarterly Waste Bank inspection report on October 12, <br />2010. The inspection was conducted on March 25, 2010, but not signed by a professional engineer until <br />September 2, 2010. Submittal of quarterly inspection reports should occur on a more timely basis. The first <br />quarter inspection did not identify any structural concerns, erosional problems, drainage concerns or maintenance <br />items.
