MINE OFFICE: <br />PO Box 1488 <br />Paonia, CO 81428 <br />(970) 527-4135 <br />Fax (970) 527-2234 <br />BOME <br />RESOURCES, LLC <br />` eelvel) <br />Certified Mail No. 7003 1010 0001 8615 1176 <br />October 11, 2010 <br />Mr. Joe Dudash <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Oct <br />7.,5 20 <br />Drt,isir'n Of RE,t.?j 10 <br />17 ,i g <br />17r?d <br />RE: PERMIT #COG-850000, FACILITY #COG-850043, BOWIE RESOURCES <br />LTD., BOWIE NO. 1 MINE, 3rd QUARTER DISCHARGE MONITORING <br />REPORTS FOR 2010 <br />Dear Mr. Dudash <br />Find enclosed the completed Discharge Monitoring Reports (DMR's) forms for <br />the 3`d quarter of 2010. <br />Bowie is requesting the Department of Health relief from total suspended solids <br />and settleable solids as described under Bowie's Wastewater Discharge Permit, Part <br />I.B.6; a) rainfall. <br />In the afternoon of August 3, 2010 in the course of approximately 1 hour, the <br />Bowie No. 1 Mine experienced a thunderstorm that exceeded the 10 year, 24-hour event. <br />This particular thunderstorm caused an uncontrollable discharge from Pond 4 or Outfall <br />004. <br />Pond 4 is the last sedimentation pond in a series of 4 ponds used to control <br />sediment from the recently reclaimed Bowie No. 1 East Mine. Pond 1 is located at the <br />top of the series and pond 4 at the bottom. During this thunderstorm, three of these <br />ponds, ponds 2 ,3 and 4 all discharged from their emergency spillway's. It should be <br />noted that Ponds 2 and 3 primary spillways valves were open but due to the magnitude of <br />the inflow, were incapable of releasing enough water and, as a result, the inflow went <br />over the emergency spillways. <br />At the time of this storm, these pond were incompliance with the State of <br />Colorado, Department of Reclamation, Mining and Safety (DRMS) requirements. The <br />ponds are inspected quarterly by both a DRMS official and Bowie and were last <br />inspected by a DRMS official on June 22, 2010 and found to be compliance. At the time <br />of the thunderstorm, ponds 1 through 4 were dry and sediment loads were below the <br />required clean out levels therefore, ponds 1 through 4 had the required storage capacity to <br />control a 10 year, 24-hour event.
