The applicant is requesting a mineral extraction,. processing, and cement <br />manufacturing operation upon approximately 875 acres of prvately_owned and <br />leased lands and approximately 5,400 acres of State leased lands. The <br />extraction activities will take place within two distinct blocks of land `consisting of <br />a westerly block of approximately 1,600 acres and an easterly block of <br />approximately 4,400 acres. The permit materials indicate the plant and initial <br />quarry site will. be within the easterly block with vehicular access via Lime Road <br />upon a private access easement and road (See Exhibits 2 and 7). A rail spur' <br />from the BNSF (former D&RG) mainline will serve the plant site in the easterly <br />block of land:":The applicant has not addressed access to the westerly block of <br />land, a portion of which straddles 1-25, except to project that the westerly portion <br />will not be mined within, the foreseeable future. <br />I The future disposition ofthe manufacturing facility, which is.considered <br />accessory to the principal use of mineral extraction, for purposes of the Pueblo <br />County Zoning Resolution, needs'to be addressed. To continue utilizing the <br />manufacturing facility after cessation of the associated cn-site extraction activity <br />would require additional review and possible permit approval, such as rezoning <br />to an appropriate industrial classification or obtaining an amended' special use <br />permit to :operate the facility under one of the listed uses-by-review within the <br />current A-1 Zone District.. Staff will require the applicant'to.submit a letter of <br />release issued by the MLRB-DMG verifying all requirements under the MLRB <br />rules and regulations have been satisfied pertaining to reclamation and the <br />applicant is released from their. bond. . <br />4. The applicant's plans depict a typical "wye" (because it looks like a Y from <br />above) rail siding serving the plant site. This configuration allows train deliveries. <br />with engines. backing into the plant site from the northbound or southbound <br />directions to spot and/or pick up loads and empties. It is imperative that the <br />applicant and BNSF design this siding and its switching and spotting movements <br />and holding tracks such that the Lime Road crossing .is not blocked for periods of <br />'time longer than it takes a northbound train to exit the plant site and pass the ` <br />crossing., Blocking the Lime Road crossing impairs potential emergency vehicle <br />access to the plant site. and other homes and sites along the southerly end of <br />Lime Road. <br />5. The applicant has submitted an executed lease for the State lands: The <br />applicant has submitted letters of intent or contracts to obtain access to the <br />proposed mining and manufacturing areas from `Lime Road. Valid Access
