Mining Permit Application <br />Gentlemen: <br />J <br />RECEIVED <br />JUN 0 3 2002 <br />Division of Minerals and Geology <br />On behalf of GCC Rio Grande, Inc., I wanted to thank you for the pre-hearing conference <br />conducted in Pueblo yesterday. Your presentations and guidance were helpful and it is clear that <br />we made solid progress towards completion of the mining permit application process. <br />I also wanted to use this letter as an opportunity to confirm our technical review meeting <br />on June 5, 2002. As we discussed with Tony Waldron at the pre-hearing conference yesterday, <br />the June 5th meeting has been confirmed and will start at 9 a.m. at the Division's office at 1313 <br />Sherman. We anticipate that GCC will have approximately eight participants at the technical <br />review session on June 5th to ensure that we have our interdisciplinary team available to make a <br />thorough presentation and answer any Division questions. <br />Finally, we are also following up on our requested extension letter of May 17, 2002. In <br />the May 17th letter, we asked for an additional time period of 45 days to address issues raised by <br />the adequacy determination letter. Currently, the requested extension timeline anticipates that <br />our adequacy responses will be filed no later than July 8, 2002. In order to allow for time to <br />have a technical dialogue with the Division, in the May 17th letter we also waived the original <br />Division determination and MLRB hearing dates. We understand however that you prefer we <br />:request an extension through a specific date to assure full compliance with the MLRB Rules and <br />Regulations. Accordingly, GCC is specifically waiving its right to a determination from the <br />Division within the required 90 day period and also waiving its right to a hearing within the <br />:required 120 day period. GCC requests that the Division and the MLRB extend the date for <br />determination and formal MLRB hearing through August 23, 2002. <br />Tijeras Plant <br />P.O.
