As I have indicated to Mr. Waldron, it is <br />important to us that we make sure we allow a reasonable period of time to allow a technical <br />dialogue and any needed technical refinements to the application to occur. As such, we <br />understand that the Mined Land Reclamation Board Rules and Regulations, Rule 1.4.5(3), allows <br />an applicant up to an additional 365 days to provide additional information to the Division. For <br />these reasons, we would like to request an additional 45 days to respond to the adequacy <br />determination, and also request that the Division establish July 8, 2002 as the date by which we <br />would plan to work through any issues and by which we would provide any additional written <br />materials to the Division. While we understand that this request will cause the current schedule <br />to be revised, we think the public's understanding of our process will be better served. <br />Based upon the positive experience we had in the course of obtaining the facility's air <br />quality permit from the Colorado Department of Public Health and Environment, a sit-down <br />technical work session(s) provides an efficient and productive opportunity to continue the <br />dialogue on technical issues associated with the application. As such, we would like to meet <br />with the Division on June 5, 2002. Further, given the relationship we have with the State Land <br />Board and our commitment to continue to work closely with them, we suggest that they also be <br />involved in the upcoming technical dialogue. <br />Please let me know if our understanding regarding the Division's availability for a June 5 <br />technical work session is correct and whether we can provide the Division with any additional <br />information in the meantime.
