The <br /> purpose of this memo is to explain the 112 Reclamation Permit application <br /> process, your rights as either a party or a non-party, and the jurisdiction of the <br /> Mined Land Board. The Office and Board operate under the provision of the <br /> Construction Materials Act (Act), if the application is for the extraction of <br /> construction materials. We operate under the Hardrock Act (Act), if the <br /> application is for the extraction of non-construction materials. <br /> If an application for a 112 Reclamation permit for a Construction Materials or <br /> Hardrock operation is approved by the Board or Office, the approved permit is for <br /> the life of the mining operation (Life of Mine) since our permits have no expiration <br /> date. The permit may be revoked and the reclamation bond forfeited to the State <br /> only by an action of the Mined Land Reclamation Board. Revocation and <br /> forfeiture may occur due to an uncorrected violation of the Act, Rules and <br /> Regulations, or the terms of the approved permit. <br /> THE ROLE OF THE MINED LAND RECLAMATION BOARD (BOARD): <br /> The Mined Land Reclamation Board (MLRB or Board) is a seven-member Board <br /> that serves at the pleasure of the Governor.
