2. Pursuant to Rules 3.1.12(2)(b), 6.2.1(2)(d), 6.4.1(1), 6.4.3(d), 6.4.4, 6.4.5, 6.4.6 and 6.4.14, the <br />application must describe and delineate the boundary of affected lands. Under Exhibit A, the <br />application identifies affected lands to include the May Day No. 1, May Day No. 2, May Day No. 3 <br />(Lamb), Chief Tunnel, Idaho Millsite, Pay Day Millsite, existing roads and the Easement. Exhibit A <br />provides the acreages for the May Day No. 1, 2 and 3, and the Idaho and Pay Day Millsites. No <br />acreages are provided in Exhibit A for the Chief Tunnel, existing roads and the Easement. Please <br />clarify the acreages of affected lands associated with the Chief Tunnel, existing roads and the <br />Easement. Please clarify that the portion of the access road, previously undermined by the <br />unpermitted construction of the Chief Tunnel, is included within the boundaries of affected lands. <br />Please augment the descriptions of affected lands, provided in Exhibit A, to include the May Day No. <br />1 Extension, bridge over the La Plata River, 11 proposed drill pads and the approximate 8,000 feet of <br />new exploration roads. Please clarify the acreages of affected lands associated with these <br />additional features. <br />3. Please ensure that the boundary of affected lands is consistently described throughout all <br />application materials. Discrepancies in the descriptions of affected lands include the following: <br />Total acreage of affected lands provided in Exhibit A = 17.89 acres; <br />Total acreage of affected lands shown on Exhibit C-1 = 19.79 acres; <br />Total affected lands per Exhibit E, section 6.4.5(2)(a) = 28 acres; <br />Total affected lands per Attachment T-4 = 28.7 acres; <br />Total affected lands per Table L-1 = 29.3 acres; <br />Total affected lands per map measurements, Figure C-4 = 36 acres (approximate). <br />NOTE: map measurements from Figure C-4, totaling 36 acres, assumed a 100 foot wide <br />corridor for exploration roads, as typical of road building activities in steep slope areas <br />NOTE: The application has not yet been found complete for the purposes of filing. However, once <br />filed, any subsequent expansion to the boundary of affected lands must be submitted for review <br />through the Amendment process, per Rule 1.1(6). Pursuant to Rule 1.8.1(3), any Amendment to the <br />filed application shall constitute a new filing for the sole purposes of determining the date for the <br />consideration of the application by the Office, and for the deadline for a final decision on the <br />application. <br />4. As shown on Exhibit C-1 and Figure C-4, the northwest corner of the existing permit boundary of the <br />May Day No. 3 is located outside of the proposed permit boundary. Yet, as shown in Exhibit A, <br />these lands are located within the approved permit boundary of the existing May Day Mine and <br />within the boundary of affected lands for CN-01. If the Operator desires to have these lands <br />released from the permit area, please submit a release request in accordance with Rule 4.17. <br />However, the Division cannot approve release of previously permitted lands through the conversion <br />process. The release request, if intended, is inappropriately placed in CN-01. Until such time as the <br />Division receives and approves an appropriate release request, all portions of the existing permit <br />2
