Pineda <br />Director <br />Re: Schwartzwalder Mine, Permit No. M-1977-300, Environmental Protection Plan AM-02, Designation as <br />Complex Application <br />Dear Mr. Whicker: <br />The Division of Reclamation, Mining and Safety (Division) has conducted a preliminary review of the Designated <br />Mining Operation Environmental Protection Plan AM-02 application submitted to this office on 13 August 2010. Based <br />on the information contained in the Amendment application, the parameters of the operation and the environmental <br />protection measures proposed, the Division has concluded that this Amendment application qualifies as a complex <br />application. <br />Therefore, under the authority granted in Rule 1.4.1(7) of the MINERAL RULES AND REGULATIONS OF THE COLORADO <br />MINED LAND RECLAMATION BOARD FOR HARD ROCK, METAL AND DESIGNATED MINING OPERATIONS, the Division is <br />extending the decision deadline for this Amendment application an additional sixty (60) days. The new decision deadline <br />shall be 10 January 2011. Although the Division is extending the decision deadline by 60 days, the decision to approve <br />or deny the Amendment application may be made at any time up until that date if the Division's adequacy concerns are <br />met.
