Headley, Deputy Director Oov <br /> DATE: March 26, 1991 <br /> SUBJECT: ERRONEOUS LEGAL DESCRIPTION, KOCHEVAR LETTER DATED <br /> SEPTEMBER 7, 1977 <br /> On September 7, 1977, then County Zoning Administrator Matt J. Kochevar <br /> issued a letter stating a property owned by James T. Hanratty was ". . .certified <br /> as a non-conforming use. . ." for ". . .extraction and processing of mineral <br /> deposits later used in the manufacture of refractory materials." (copy attached) <br /> The legal description contained in Mr. Kochevar's letters has been found to be <br /> in error. it is unclear as to the source of the legal description used by Mr. <br /> Kochevar; however, it has been determined the legal descriptions applied to <br /> properties not owned by Mr. Hanratty and which to our best determination have <br /> never been mined. <br /> Based upon the January 31, 1955 lease between Mr. Hanratty and Rudolph <br /> Velenta and the subsequent lease assignment to General Refractories Company <br /> on February 11, 1955 (copies attached), the legal description for the <br /> non-conforming use should have been as follows: <br /> The Southwest quarter of the Northeast quarter; the Northwest <br /> quarter of the Southeast quarter; the Northeast quarter of the <br /> Southwest quarter and the Southwest quarter of the Southeast quarter; <br /> all in Section 30, Township 22 South, Range 67 West. <br /> Also; the West one-half of the Northeast quarter; and the Northeast <br /> quarter of the Northwest quarter of Section 31, Township 22 South, <br /> Range 67 West. <br /> Non-Conforming Use Certificate No. 91-10 has been authorized for the above <br /> legal description and, as such, supersedes Non-Conforming Use Permit No. 0, <br /> under the name of James T.
