Thompson , do solemnly swear that I am the customer service representative of the Durango Herald, and <br />that I have personal knowledge of the essential facts stated herein; that the same is a daily newspaper printed in whole, and <br />_______ _p11blished-in.the County of La Plata, State of Colorado, and has a general circulation therein; that said newspaper has been <br />published contRibusly and uninterruptedly in said County of La Plata for a period of more than twelve months next prior to the <br />first publication of the annexed Legal notice or advertisement; that said newspaper has been admitted to the United States mails as <br />second-class matter under a provision of the Act of March 3, 1879, or any amendments thereof, and that said newspaper is a daily <br />newspaper duly qualified for publishing legal notices and advertisements within the meaning of the laws of the State of Colorado. <br />That the annexed legal notice or advertisement was published in the <br />regular and entire editions of said daily newspaper one time only, <br />XXXXX, once each day for XXXXX consecutive issue days; once each week <br />on the same day of each week for 2 consecutive insertions; and that the first <br />publication of said notice was in the issue period of said newspaper dated <br />September 24, 2010 and that the last publication of said notice was in the issue <br />of said newspaper dated October 1, A .D., 2010. <br />In witness whereof I have hereunto set my hand this 1st day of <br />October, A.D., 2,01.0. <br /> <br />30264 <br />Notice of Proposed- Decision. <br />The Colorado Division;,- of <br />Reclamation, Mining and' Safety <br />(the Division) has issued a pro- <br />posed decision to Approve Bond <br />Release Application No. 1 (SL-1) <br />and terminate the Division's regu- <br />latory jurisdiction for the Arness <br />McGriffin Mine, Permit Application <br />No. C-1981-042. The. affected <br />area is located in La Plata County, <br />approximately 4 miles West of <br />Durango on the north side of U.S. <br />Highway 160. The operator, Sam <br />Arness, applied for a coal mining <br />and reclamation permit for the <br />site (Application No. C-81-042), <br />but did not complete the applica- <br />tion process. The operator had <br />disturbed 5 acres on the site in <br />preparation for underground coal <br />mining, but ceased operations <br />prior to excavating a portal and <br />underground entries. The Mined <br />Land Reclamation Board issued <br />a Cessation Order in 1984, and <br />ordered forfeiture of $13,750 of <br />reclamation bond that had been <br />associated with permit 77-3 ug/c, <br />a Minerals Program permit 77-3 <br />ug/c that had been applicable to <br />the site. <br />The Division reclaimed the <br />disturbed area on the Arness- <br />McGriffin site in 1989 and 1990, <br />using all of the funds from the <br />forfeiture of bond associated with <br />permit 77-3 ug/c. The Division <br />prepared a bond release/termina- <br />:tion of jurisdiction findings docu- <br />ment in 2010. <br />Copies of the proposed decision <br />are available for review at the <br />Colorado Division of Reclamation, <br />Mining and Safety office, 1313 <br />Sherman Street, Room 215, <br />Denver, .Colorado 80203, and at <br />the office of the La Plata County <br />Clerk & Recorder. <br />Any person who has an interest <br />which is or may be adversely <br />affected may request an adju- <br />dicatory hearing regarding this <br />proposed decision. Requests for <br />a hearing must be made in writ- <br />ing within thirty (30) days of the <br />first publication of this notice, and <br />shall state with reasonable speci- <br />ficity the reasons for the request . <br />and objections to the -'proposed <br />decision. <br />Published: September 24 and <br />October 1, 2010 <br />Subscribed and sworn before me, a notary public in and for the <br />County of La Plata, State of Colorado this day of October, A.D., 2010.
