Pineda <br />Director <br />The above referenced report was prepared by North West Colorado Consultants (NWCC) for <br />Twentymile Coal Company. NWCC visited the site on July 14, 2010 and on September 29, 2010. <br />Based on the report NWCC noted an erosion channel on the east side of the refuse pile that should be <br />addressed in order to curb further erosion. No signs of instability, structural weakness or hazardous <br />conditions at the refuse pile. According to the report, the wash plants produced approximately 251,721 <br />tons of waste coal. On July 14, 2010 a total of five compaction tests were conducted and all tests met <br />the minimum compaction requirement of 90% of the maximum standard Procter density. It is noted <br />that the second quarter inspection report mentioned that no compaction tests were conducted; however, <br />five compaction tests were conducted on April 12, 2010. <br />As of the date of the report, stripping of topsoil and cover materials continue. Construction of the new <br />haul road to the south of the existing pond had also begun. A total of 198,771 of waste coal were <br />produced during the third quarter of 2010. <br />Please note that the erosion identified in the first and second quarter reports have yet to be "- -- -? <br />repaired. In addition, three additional shallow erosion channels have developed several hundred <br />feet to the south. It is NWCC's recommendation that these small gullies be repaired to prevent <br />further down cutting and erosion of the pile. <br />If you have any questions feel free to contact me.
