The uses of rangeland, pastureland and cropland for the reclaimed areas are identical to the premining land uses <br />• found in the area as discussed under Rule 2.04.3. The limitations of changing to an alternative land use are fully <br />discussed in that Section as required by Rule 4.16. There will not be a change in premining land use as shown on <br />Map 3, Premining Land Use. <br />Approval from the existing state and local government units is not necessary to restore the premining land use <br />because the post- mining land use will be consistent with the premining land uses. <br />Rule 2.05.6 - Mitigation of Surface Coal Mining Operation Impacts <br />(1) Air Pollution Control Plan <br />(a) All permit applications for existing operations shall contain a copv of an initially approved <br />or finally approved emission permit if applicable from the Colorado Air Quality Control Commission, Air Pollution <br />Control Division or the Air Quality Hearing Board. All pen applications for new operations shall contain a copy <br />of the application for such emission permit and shall be updated accordingly as initial or final decisions are <br />rendered. <br />(b) All permit applications shall contain a description of the steps to be taken, including copies <br />of permits or permit applications, if any, to comply with other applicable State or Federal air quality laws or <br />regulations. <br />RESPONSE <br />TCC will employ fugitive dust control measures as an integral part of all mining and reclamation activities. Copies <br />• of Emission Permits Nos. 82RO302 -1 and 85RO302 -2 approved by the Colorado Department of Health, Air <br />Pollution Control Division (CDOH- APCD), are included as Exhibit 29, Emission Permits. The applications will be <br />updated as necessary. <br />A copy of the Emission Permit for the Fish Creek Operation is presented in Exhibit 9, Emission Permits of the Fish <br />Creek Tipple/Loadout Appendix. Fugitive dust control measures are further explained within pages 2.05 -63 <br />through 2.05 -64 of Volume VII, Fish Creek Tipple/Loadout Appendix. <br />(2) Fish and Wildlife Plan <br />provides: <br />(a) Each application shall contain a fish and wildlife Ulan, consistent with 4.18 which <br />(i) A statement of how the plan will minimize disturbances and adverse impacts on <br />fish and wildlife and related environmental values during surface coal mining and reclamation operations, and how <br />enhancement values during surface coal mining and reclamation operations, and how enhancement of these <br />resources will be achieved. where practicable. The plan shall cover the permit area and portions of adiacent areas <br />as determined by the Division pursuant to 2.04.11. <br />(ii) If the applicant stales that it will not be practicable, in accordance with <br />2.05.6(2)(a)(i), to achieve a condition which clearly shows a trend toward enhancement of fish and wildlile <br />resources at the time revegetation has been successfully completed under 4.15, a statement shall be provided which <br />establishes, to the satisfaction of the Division. why it is not practicable to achieve such a condition; and <br />• <br />APPROVED APR 2 4 2000 <br />Permit Renewal No. 3 2.05 -124 4/1/99 <br />
