The Union Pacific Railroad Company (UPRR) has trackage which traverses a portion of the proposed Eastern <br />Mining District. The track leads to TCC's Foidel Creek Mine and is utilized by the mine to ship coal to its <br />customers. Agreement has been reached with the UPRR to allow TCC to subside the track. <br />. Three residences are located within the Eastern Mining District, and TCC is the owner of one of these residences. <br />Therefore, no problems are anticipated in obtaining landowner approval for undermining and subsiding the <br />residence owned by TCC. In reference to the other two residences, both owned by the same party, negotiations <br />have resulted in the required approvals to subside the properties. <br />Finally, the Lieske Ditch headgate is located on Middle Creek and will fall within the subsided area. TCC is the <br />owner of this headgate and ditch, and has no problems with the undermining and subsiding of the headgate. <br />NORTHERN MINING DISTRICT (PR 99 -05) <br />The expansion of the mine into the Northern Mining District (NMD) will result in the undermining and subsiding <br />of structures located over the mining area. The area to be mined is depicted on Map 23, Mine Plan. The structures <br />located within the NMD include Routt County Road 33, the railroad, and powerlines. The major land use in the <br />area is for pastureland, with cropland and rangeland being minor land uses. <br />In reference to Routt County Road 33, TCC enlisted the services of SubTerra, Inc., to evaluate the potential <br />impacts to the road. The report is presented in Exhibit 7F -1. TCC will follow the recommendations within this <br />report for maintaining the road to assure public safety. The powerlines are located outside of the angle of draw <br />resulting from mining in the NMD; therefore, TCC is not anticipating any impacts to these lines. <br />The railroad will be undermined and TCC will repair any damage to the track resulting from its mining activities. <br />TCC has successfully undermined sections of the track in the 9 Right, 8 Right, and 7 Right longwall panels without <br />causing any significant impacts to the track configuration or railroad operations. Any required maintenance and <br />repair efforts were coordinated with the UPRR personnel, resulting in a very efficient method for maintaining the <br />. track, during the brief period of active subsidence. Ongoing monitoring and maintenance efforts will be continued <br />during active subsidence as the mining moves into the Northern Mining District. <br />WESTERN MINING DISTRICT (PR09 -08) <br />Development and mining of the Western Mining District (WMD) will result in undermining and subsidence of <br />structures located over the mining area and within the subsidence limits. The area to be mined is depicted on Map <br />23, Mine Plan. The structures located within the WMD include portions of Routt County Road 27, several <br />powerlines, and segments of Fish Creek. The major land use in the area is for pastureland, with minor cropland <br />and rangeland uses. <br />In order to identify and address potential subsidence effects on Routt County Road 27, powerlines, and Fish Creek, <br />TCC contracted with SubTerra, Inc. to complete a subsidence and impact evaluation for the proposed WMD <br />mining operations.The results of this evaluation, and specific recommendations for controlling and mitigating any <br />surface subsidence effects, are summarized in the SubTerra evaluation report provided in Exhibit 25Z Western <br />Mining District Subsidence Review (PR09 -08). TCC will follow the recommendations within this report for <br />maintaining the road to assure public safety. Given that TCC has successfully undermined both powerlines and <br />Fish Creek in the recent past, no additional monitoring for Fish Creek is planned, and monitoring of powerlines <br />will be consistent with the procedures previously used in the NMD. <br />RULE 2.04.4 - CULTURAL AND HISTORIC RESOURCE INFORMATION <br />The application shall contain a description_ o f the cultural and historic resources listed on the national <br />register of historic places and knows archaeological features within all areas proposed or likely to be affected by <br />• surface activities or planned or probable subsidence over the life of the mine. The description shall be based on all <br />available information including but not limited to data of State and local archaeological, historical, and cultural <br />preservation agencies. <br />PR09 -08 2.04.8 09/29/09 <br />
