You enclosed a copy of .your. <br />letter dated August 27, 2010, to Ms. Marcia Talvitie, the inspector for DRMS who inspected <br />the reclaimed Carbon Junction Mine. <br />I am the Field Office Director with responsibility for overseeing administration of the <br />regulatory program by DRMS. I have discussed your concerns with DBMS and have reviewed <br />the response from Loretta Pineda, Director of the DRMS to Oakwood Energy dated September <br />8, 2010. I am satisfied with Director Pineda's explanation of Ms. Talvitie's responsibilities <br />with regard to the Carbon Junction Mine. You also ask that OSM review your rebuttal to <br />conclusions made by Ms. Talvitie in her inspection report. My understanding is that Ms. <br />Talvitie's conclusions do not require any reworking of the reclaimed area. Because there is no <br />required action, OSM will not attempt to resolve differing professional conclusions.
