C-81-014 <br />REQUEST TO TERMINATE INSPECTIONS OF REFUSE DISPOSAL AREA (RDA) <br />Dear Janet Binns: <br />As I have mentioned previously, Energy Fuels (EFCI) has experienced delay in receiving the <br />required professional engineer's (P.E.'s) certifying stamp from the contract engineer, Peak Project <br />Management of Trinidad, Colorado concerning final inspection of EFCI's Southfield mine Refuse <br />Disposal Area (RDA). Please notice that our letter (enclosed) requesting termination of inspections of the <br />RDA is dated January 10, 2010 and that it is addressed to Mr. Kent Gorham, who was the Division's <br />assigned inspector for Southfield at that time. Peak Project conducted the inspection of the RDA March <br />25, 2010 during the first quarter and confirmed that in their opinion, reclamation of the RDA was <br />successful and quarterly waste bank inspections could be terminated at that time. However, EFCI did not <br />receive the P.E.'s certification of the report until after 9-2-2010. <br />Given that EFCI initiated this Inspection Termination Request in January and the contract <br />engineer assessed the RDA March 25, 2010 as their final inspection, EFCI respectfully requests that the <br />Division approves termination of the RDA quarterly inspections/reports effective on or about March 31, <br />2010. <br />If you have questions or require further information, please contact me. <br />Sincerely, <br />tiVo-rge V Patterson <br />General Mine Mgr <br />ENERGY FUELS COAL, INC.
