Pineda <br />Director <br />The Division has reviewed the updated ownership and control information submitted October 1, 2010 <br />by Seneca Coal Company (SCC), in response to our September 14, 2010 adequacy review letter for <br />TR-71 at the Seneca II-W Mine. We compared the information SCC submitted with the current <br />information found in the Applicant Violator System (AVS), and have the following comments: <br />Peabody Energy Corporation <br />1) In AVS, Wilber E. James (entity no. 146052) is listed as a "Director" with a Begin Date of July <br />18, 2001, but Wilber E. James is not listed on the permit pages for Peabody Energy. Please <br />either correct the permit pages or have AVS updated. <br />2) On the permit pages for Peabody Energy, William E. James is listed as holding three offices; in <br />AVS the officer listed for those three offices is James E. William (entity no. 250509). Please <br />either correct the permit pages or have AVS updated. <br />Peabody Investments Corp <br />3) Please have AVS updated to show the following officers that are listed on the revised Permit <br />Pages: <br />Robert F.
