(Wetter frro n Cathy Begej to Mr. Ranney stating that she is concerned by Westem Fuels trying <br />to short-cut requirements of baseline monitoring and the Hydrology studies that have been done. <br />All of Peabodys documentations needed to be reincorporated into NEW Permit. <br />(9) Letter of March 1993 from Westem Fuels to Harry Ranney. Western Fuels states that most of <br />the ground is presently IRRIGATED grassland for pasture. This permit included Mel Staats, <br />Goforths, and some of San Miguels Powers leased by Frank Morgan. All of these properties <br />were irrigated and CROPPED, and then grazed during the winter for pasture but by 1.04 <br />definition, they were cropland. <br />(10) Western. Fuels specifically state themselves the BARX soils was prime farmland but it was <br />only 1 acre and this piece of Barx received NO irrigation so it is not considered prime farmland <br />based on letter of 1992 from Deans Stindt. <br />(11.) ALL available TOPSOIL will be salvaged. Again, commitment from Western Fuels and <br />accepted by DRMS. <br />(1.2) Permit Renewal 42 1993. Again stating "Reincorporate the baseline information and maps <br />from the old Peabody permit concerning `Nucla East topsoil recovery and Prime Fatnnland. <br />designation into New Horizon 2 permit document. <br />(13) As you can clearly see, at this point, there was numerous discussions concerning prime <br />farmland and Barx soils. <br />(14) Barx soils were determined prime farmland soils, they were reincorporated into New <br />Horizon 2 mine documentation, Dean Stindts letter was "Site Specific" and did not include any <br />areas outside what was shown to him.. <br />(15) Documented in Permit Renewal #2 "Most of the land surrounding the permit area is <br />Agricultural Irrigated and non-irrigated Farmland which produces ALFALFA and pasture." <br />This is the Morgans, the Burbridges, the Garveys, Bensons, Martins place, and San Miguel. <br />Powers property. If the State had just visited the farmers and read all of the documentation. <br />(I6)The New Horizon Mine 1, the rice tract, had been historically irrigated and cropped, but <br />again they changed it to dryland. <br />(17) The definition of Pastureland as Rule 1.04 states is land that is used for grazing and only <br />occasionally bayed not as ALL of these lands were harvested 2 and three times a year putting up <br />enough hay to take care of their livestock through the winter. All of the land uses were not <br />appropriate with rule 1.04. Rules also state that any one giving data or technical support must <br />provide documentation that conforms with the Mules and Regulations. All of these were <br />cropland. <br />(18) Submitted 1997 prepared by Ross Gubka. ".Prime Farmland Investigations NOT <br />Applicable."
