This Complaint is very complex and will take an initial visit <br />from OSM or the opportunity to meet to present other critical documentation. 1 am filing the <br />complaint based on the State Regulatory agency in charge of Surface coal mining failed to <br />implement, enforce, and maintain its approved State Program as provided for in this Act. The <br />Operator, Western Fuels did. not sufficiently furnish to the Division all the factual information <br />that they had available to them. I will start from the beginning and try and explain the best that T <br />can what has happened. <br />Frank Morgan is blind and he cannot see, read, nor write. The things that are happening present <br />is solely up to us to try and protect. Mar. Morgan is the owner of the property being mined, but <br />JoEllen Turner and. Michael Morgan has leased it for 19 years, all the surface rights to farm. <br />Michael .Morgan, is the Son of Frank Morgan and has farmed this his entire life, knowing that <br />someday this would be his property. The Center Pivot, siderolls, and most of the equipment used <br />to farm this place belongs to JoEllen Turner, the daughter-in-law of Frank Morgan. The gated <br />pipe, big guns, handsets, and most all other equipment belong to Michael Morgan. Michael <br />Morgan does most of the irrigating of this property while JoEllen Turner does most of the <br />farming. Michael is a welder, mechanic, operator, and jack of all trades. <br />Frank Morgan has operated this farm which has been. historically irrigated and cropped for 59 <br />years. Mr. Morgan raised sheep and cattle until 1987 at which time he sold off his livestock and <br />began raising "cash crops." We do not have any livestock and have found. that there is much <br />money in "cash crops" since we are the only ones in this entire area that solely do that. <br />Production is a very critical issue for this farm. We initially raised our majority of our <br />production from the property being mined. <br />From years back, we have it documented even in 1985 as "BAIL" soils and prime farmland. <br />When the USDA made a visit to this place in the 1990`s, they said it was the most efficiently <br />irrigated place in the area. We had beautiful alfalfa, fields, com fields, and were trying to <br />improve every year with different methods and more production. We were in negotiations with <br />others to possibly raise sunflowers and canola. We had been looking at expanding into other <br />areas owned by Mr. Morgan to include other types of cash crops that at that time seem, to be <br />bringing in a lot of money in other areas. <br />These are the facts and the things that have happened to us: <br />The State Regulatory Program did not implement, enforce, and maintain it's approved State <br />Program as provided for in this Act.
