In regards to MR248, it looks like the Division is going to
have to have this revision resubmitted as a TR for the purposes of filing. Based on Rule 2.08.4(6)(b)(ii), Rule 4.05.3(1)(c)
and"the definition of "Technical Revision" under Rule 1.04(136), the activities proposed in Minor Revision No. 248
constitute a need to comply with hearing and notice requirements as well as design change for the temporary diversion
proposed in Foidel Creek. If it is TCC's intention to re-submit the Minor Revision No. 248 application as a Technical
Revision, please submit a withdraw request for Minor Revision No. 248.
I have sent the attached letters as well as the incompleteness letter for MR248.
Please let me know if you have any questions.
Thanks,
Jason
Jason Musick
Environmental Protection Specialist
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Deriver, CO 80203
303-866-35617; Extension 8134
303-832-8106 Fox
Jason. musick@state. co. us

1
