as noted in our first and second quarter inspection reports, had not been repaired. In addition, three
additional shallow erosion channels have developed several hundred feet to the south. We recommend that
the channels be re-graded so that the drainage does not concentrate in these areas and cause further erosion.
It should be noted that at the time of our visit, we did not observe any signs of instability, structural
weakness or hazardous conditions at the pile. It should be noted that the internal roadways in the pile, as
well as the haul road were in good condition.
The stripping of the topsoil and cover materials in the refuse pile expansion area had also continued during
this quarter. Bower Brothers Construction had continued stockpiling the topsoil and cover materials in the
southern and eastern portions of the site. Bower Brothers Construction had also started construction of the
new haul road to the south of the existing pond.
As suggested, the water levels in the monitor wells installed on October 23, 1997 and December 9, 1999
were measured during this quarter on a monthly basis.. A table and graphs showing the monthly water
levels are attached.
We were advised that the wash plants had produced approximately 75,621 tons of waste coal during the
month of July 2010: approximately 58,457 tons during August 2010: and approximately 64,693 tons during
September 2010. It is our understanding that the fines being produced at the wash plant, which consists of
approximately 10 to 20 percent of the total materials being produced, are being pumped underground into
the mine.
Based on our limited observations, it appears that the pile is currently being constructed and maintained in
general accordance with the project specifications and plans submitted under 2.05.3(8) and that the
potential hazard to human life and property at the site in its present condition is minimal. This report
fulfills the quarterly inspection requirements as specified by Rules 4.09.1(1 ])(a), 4.09.1(11)(b), 4.10.2(2)(a)
and 4.10.2(2)(b).
If you have any questions regarding this report or our observations, please contact this office.
Sincerely,
NWCC, INC.,
O•• d•h?NF
Timothy S.
