CDOT Utilities can't legally sign agreements, and is only authorized to issue utility
permits. In order to avoid possible delays in involving the AG's Office, we can issue the Five Rivers
Cattle Co. a utility permit to trench under US-50. I will also attach a cover letter to the permit
stating "THE MINING OPERATION WILL NOT ADVERSELY AFFECT THE STABILITY OF ANY
SIGNIFICANT, VALUABLE AND EPRMANENT MAN-MADE STRUCTURE LOCATED WITHIN
TWOO HUNDERED (200) FEE OF THE AFFECTED ALND". The issued permit and cover letter
should cover all the requirements listed on the letter from the Division of Reclamation, Mining and
Safety.
In order to get this permit processed, we will need insurance naming CDOT under it's coverage,
traffic control plan, brief explanation of the work, project plans (we may have them on file), and a
copy of CDOT Form 1233 (Utility Permit). I have attached a copy of the permit application for your
convenience. Please see page two of the permit application for further information.
Mark Nusskern has been working on this permit since April 2009. The person he has been dealing
with is Shane Self, with Enviro-Ag.
Please see the following correspondence that has taken place between Mark and Shane:
From: Shane Self [mailto:sself@envlroaaSQM]
Sent: Wednesday, February 03, 2010 10:25 AM
To: Nusskern, Mark
Cc: Trevizo, Joe; Marquez, Rudy E
Subject: RE: Preliminary approval
Thanks Mark, this is what I needed.
From: Nusskern, Mark [mailto: Mark, Nusks emftdot.state.co.us]
Sent: Tuesday, February 02, 2010 11:32 AM
To: sselfCa enviroaq,com
Cc: Trevizo, Jae; Marquez, Rudy E
Subject: Preliminary approval
Shane,
Sorry I did not get to this sooner.
This is to serve as confirmation of preliminary approval for the bore you intend to place under US
50/287 in the Lamar Area for Colorado Beef Feed yard on SH ROW.
P)
