S'3a- <br />? 03? a? lga? <br /> <br />The Morgans had several lengthy discussions again and wanted me to write another letter <br />addressing some of their thoughts. <br />Western Fuels has indicated. strongly in PR-06 that we have not tried to work anything out <br />since the lawsuit. This is what has been, tallied about and discussed. In PR-06, Greg L.ewicki <br />indicated that we Demanded or else which is a very untrue statement. The letter of settlement <br />was written from the bottom of Mr. And Mn. Morgans heart. I did not attend those discussions <br />because I felt this was something that all of the family of the kids and them should discuss this <br />alone and come to a decision without any of my opinions. Many calls were made pricing Pnme <br />topsoil. Not just topsoil which is dirt sifted through a screen, but actual Barx/Darvey quality <br />prime soils. Theme was nothing to match or equal that quality nor quantity available. So, the <br />figures we got were for just topsoil that we would not accept, but to get a price quote for what <br />they were looking at, we used those figures. <br />This proposal today is not to be construed as an admission of guilt by Western Fuels and in fact <br />this letter is not to be documented to be used against or for either party concerned. This is simply <br />a letter to maybe help resolve all of the issues in question. Western Fuels obviously did not like <br />the figures suggested for a settlement price, so the Morgans would like Western Fuels to offer a <br />realistic figure based on. their own research as to the prices of prime topsoil. If the settlement <br />figure is agreed upon, then the rest of the other. offer will. be honored as well as dropping all <br />lawsuits against the State as well as Western Fuels. T'here is one small stipulation to this. The <br />Morgans will write a document of less than 10 pages, summarizing seeding, irrigation, farming <br />practices, fertilizing, soil preparation, soil redistribution, etc affecting only the Morgans properly <br />that we would also present to the State and would be incorporated into PR-06 for approval so that <br />our property could be restored to as good as it was with the compensation. No one understands <br />the farming of this place better than us and no one can ever make it produce as good as we did. <br />So, by us submitting all of this, we know bond release could be achieved. <br />Thank you for your time, <br />..
