Pineda <br />Director <br />Thank you for your correspondence dated September 16, 2010, in which you informed the Division of <br />your intension to use the illegal May Day road to collect firewood. As discussed previously, the illegal <br />road was constructed by Wildcat Mining Corporation (Wildcat Mining) in 2008 and is the subject of two <br />violations issued by the Colorado Mined Land Reclamation Board. The Board has ordered Wildcat Mining <br />to incorporate the illegal road into an approved reclamation permit. The Division anticipates that Wildcat <br />Mining will soon submit an application intended to satisfy the Board's orders. <br />To date, Wildcat Mining has not successfully demonstrated the stability and safety of the illegal road. <br />Based on geotechnical information submitted by Wildcat Mining and observations made by Division staff <br />members, the Division has determined that the road, in its current condition, should not be utilized by any <br />size vehicle. The illegal road may be unsafe for use by motorized vehicles of any size. The Division <br />recommends that you do not use this road in pursuit of your proposed wood cutting activity. <br />Your proposed activity appears unrelated to mining.
