Martin
Executive Director
Loretta E. Pineda
Director
Thank you for your correspondence dated September 16, 2010, in which you informed the Division of
your intension to use the illegal May Day road to collect firewood. As discussed previously, the illegal
road was constructed by Wildcat Mining Corporation (Wildcat Mining) in 2008 and is the subject of two
violations issued by the Colorado Mined Land Reclamation Board. The Board has ordered Wildcat Mining
to incorporate the illegal road into an approved reclamation permit. The Division anticipates that Wildcat
Mining will soon submit an application intended to satisfy the Board's orders.
To date, Wildcat Mining has not successfully demonstrated the stability and safety of the illegal road.
Based on geotechnical information submitted by Wildcat Mining and observations made by Division staff
members, the Division has determined that the road, in its current condition, should not be utilized by any
size vehicle. The illegal road may be unsafe for use by motorized vehicles of any size. The Division
recommends that you do not use this road in pursuit of your proposed wood cutting activity.
Your proposed activity appears unrelated to mining. Please seek permission from the landowner.
Ultimately, the landowner will determine if your proposed use of the road should be allowed.
Please contact me at the Division's office in Durango at 691 County Road 233, Suite A-2, Durango, CO
81301, phone (970) 247-5469, if you have any questions.
Si?n?ceurel
Wallace H.
