6. The Applicant has stated "mining at the south property boundary of the pit will be sloped 10:1 out <br />to the full depth of the excavation". Please clarify if the 10H:1V slope will be created within the bed <br />of the Arikaree River or outside of the channel. In addition, please explain how creating a 10HAV <br />slope will minimize downcutting of the Arikaree River. <br />The 10H:1 V slope will be created within the bed of the normally dry Arikaree River. Water flowing from <br />the Arikaree north into the mined area will be significantly slowed by the greatly reduced slope, hopefully <br />reducing any major downcutting as it flows into the pit area. <br />6.4.7 Exhibit G - Water Information <br />7. The Applicant has stated the Operator will "attempt to keep stockpiles outside of the flow area". <br />Product stockpiles located with the Arikaree River could lead to increased turbidity of the water when <br />the river is flowing. The Division requests the Applicant commit to keeping all stockpiles outside of <br />the Arikaree River to prevent pollution of the water. <br />We will commit to keep stockpiles outside of the Arikaree River. <br />8. The Applicant has stated water flow would be able to pass through the site. Please clarify if you <br />are referring to water flowing through the portion of the mine site that is located within the Arikaree <br />River or through the portion of the mine site that lies outside of the Arikaree River. Please note that <br />storm water shall be contained within the site for all areas that lie outside of the Arikaree River. If <br />storm water will be exiting these areas, then the Applicant will need to apply for a storm water <br />discharge permit from the Colorado Department of Public Health and Environment. <br />When we referred to water flowing passing through the site, the reference was to water flowing through <br />the portion of the mine site that lies within the Arikaree River. Storm water will be contained within the <br />site for all areas outside the Arikaree River.
